1. About these Terms
1.1 These Terms and Conditions ("Terms") apply to your use of the Often Outdoors website at oftenoutdoors.com ("Website") and any purchase you make from us.
1.2 By placing an order, you confirm that you have read, understood, and agree to these Terms.
1.3 We are NG Mobility Pty Limited (ABN 47 664 248 604), trading as Often Outdoors, of 232 Montague Road, Tenancy 2, West End QLD 4101, Australia.
2. Orders and payment
2.1 All prices on the Website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) unless otherwise stated.
2.2 We may change prices without notice. The price charged is the price displayed at the time of your order.
2.3 We may cancel an order if a product is incorrectly priced due to a genuine error. In that case you will receive a full refund of any amount paid.
2.4 When you place an order you will receive an order confirmation email and your payment method will be authorised for the purchase. If an item is unavailable, we will contact you to discuss alternative options or provide a refund.
2.5 Title in goods passes to you upon receipt of full payment.
2.6 We accept Visa, Mastercard, American Express and UnionPay, and the Apple Pay, Google Pay, Shop Pay and PayPal wallets. Afterpay is available as a buy now, pay later option, subject to Afterpay’s eligibility criteria and approval. Afterpay is provided by Afterpay Australia Pty Ltd, not by us. The payment methods available to you are those displayed at checkout. We do not store your full card details; payments are processed by our payment providers.
2.7 Where you pay a deposit or use a deferred or recurring payment arrangement, you authorise us to charge the remaining balance before delivery or collection. You may cancel future charges at any time by written notice. Deposits are non-refundable 48 hours after payment unless the order is cancelled in writing within that period, we are unable to fulfil the order, or a consumer guarantee under the Australian Consumer Law applies. Our deposit and split payment options are set out on our Payment and Deposit Options page, which forms part of these Terms.
3. Delivery and pickup
3.1 We aim to dispatch orders within three business days of payment. Delivery timeframes are estimates only and are not guaranteed.
3.2 Standard shipping is free on orders of $150 or more. Below that threshold, standard shipping is $19 to ACT, NSW, QLD, SA and VIC, and $29 to NT, TAS and WA. Express delivery is available as a paid option. All rates are shown at checkout.
3.3 You may collect your order from our West End location at no charge by selecting local pickup at checkout. Orders are usually ready within four hours during business hours and we will email you when your order is ready.
3.4 Tracking information is emailed within 24 hours of dispatch. If you have not received tracking information within four business days of your order, contact us at hello@oftenoutdoors.com.
3.5 If dispatch is delayed, we will notify you of the revised timeframe and offer the option to cancel for a full refund.
3.6 Please inspect the packaging of your order on delivery. If you observe damage, note it when signing for delivery and send photographs to hello@oftenoutdoors.com within 48 hours so that we can lodge a transit insurance claim and arrange a replacement or refund.
4. Returns, repairs and refunds
4.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
4.2 Our returns process, change-of-mind policy, and warranty claims procedure are set out in our Refund and Return Policy, Warranty Policy, and Cancellation Policy, which form part of these Terms.
5. Product information and safe use
5.1 Our products are outdoor and camping equipment intended for recreational use. Information on product pages, including dimensions, weights, capacities, and weather ratings, is general in nature and is provided to help you choose a suitable product. It does not guarantee performance in every condition.
5.2 You represent that you have read the product manuals and instructions supplied and will follow them, including any stated limits on load capacity, inflation pressure, wind rating, and mounting requirements.
5.3 Rooftop tents and vehicle-mounted products must be fitted only to a vehicle and roof rack rated for the load, in accordance with the manufacturer instructions for both the tent and the vehicle. It is your responsibility to confirm that your vehicle and rack are suitable and that the installation complies with applicable road rules in your state or territory.
5.4 Products that involve fire, gas, or fuel, including stoves, grills, fire pits, and lanterns, must be used strictly in accordance with their instructions, never inside a tent or an enclosed or unventilated space, and in compliance with local fire restrictions and total fire bans.
5.5 Camping carries inherent risks, including weather, terrain, fire, and the conduct of others. To the extent permitted by law, and subject always to the Australian Consumer Law, you assume responsibility for risks arising from your use of the product, and Often Outdoors is not liable for loss or injury caused by your misuse of the product, your failure to follow the manual, or your breach of applicable laws or fire restrictions.
6. Intellectual property
6.1 All content on the Website, including text, images, logos, and product descriptions, is owned by or licensed to NG Mobility Pty Limited and is protected by copyright. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
7. Limitation of liability
7.1 To the extent permitted by law, our liability for any loss or damage is limited, at our option, to the replacement or repair of the goods or a refund of the purchase price, and we are not liable for indirect or consequential loss.
7.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.
8. Privacy
8.1 We collect and handle your personal information in accordance with our Privacy Policy, available on this Website.
9. Amendment of these Terms
9.1 We may amend these Terms from time to time by publishing the updated Terms on the Website. Amendments apply to orders placed after the date of publication. Orders already placed are governed by the Terms in force at the time of the order.
10. Governing law
10.1 These Terms are governed by the laws of Queensland and the Commonwealth of Australia. Any dispute is subject to the non-exclusive jurisdiction of the courts of Queensland.
